Data protection

Protecting your privacy and complying with legal data protection regulations are a matter of course for us.

Below we explain when we store your data when you use our website and how we use it.

The use of our website is possible without providing personal data. When you use our website for purely informational purposes - i.e. if you do not register anywhere and do not send us any form data - we only collect the data that your browser transmits to us for technical reasons, such as your IP address. This technical data is collected exclusively to ensure the technical and graphic functionality of the website. This data will be deleted immediately after you leave the website. It will not be passed on to third parties. The legal basis for this temporary storage is Article 6 Paragraph 1 Letter f GDPR.

If additional personal data is collected using contact forms on our pages (such as name, address, telephone number or email address), this is done on a voluntary basis or as necessary to take pre-contractual measures. The legal basis for processing is Article 6 Paragraph 1 Letters a and b GDPR.

All data will only be used to answer your inquiry or to carry out a contract you have concluded with us, will be stored exclusively on our servers in Germany and will not be passed on to third parties without your express prior consent. We do not record user data for later use.

The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected and there are no legal retention periods to the contrary.

According to Articles 12, 13 ff of the GDPR, you have the right to free information at any time about your data stored by us, as well as about its use, the recipients and the planned storage period. If, contrary to our care, personal data is not recorded correctly, you of course have the right to correction (Art. 16). If the legal requirements are met, you can also request the deletion (Article 17), the restriction of the processing of your personal data (Article 18), or object to their processing (Article 21).

In addition, if the legal requirements are met, you can request the transfer of your personal data in a machine-readable format (Article 20).
It is possible at any time to revoke your consent to the collection, processing and use of your personal data without giving reasons, Art. 7 Para. 3, 6 Para. 1 Sentence 1 Letter a GDPR. Revoking consent does not affect the lawfulness of processing based on consent prior to its revocation. You also have the right to lodge a complaint with the responsible data protection supervisory authority (The State Commissioner for Data Protection in North Rhine-Westphalia, Kavalleriestraße 2-4, 40213 Düsseldorf).

Internet pages use small text files that are stored on your computer by your browser when you use the website (“cookies”); According to the current state of technology, these are harmless and do not contain any viruses. We only use so-called “session cookies”, which provide technical support for our website and only serve to make our offering more user-friendly, effective and secure, Article 6 Paragraph 1 Letter f of the GDPR.

With the following information we give you an overview of how we process your personal data and your rights under data protection law. Which data is processed in detail and how it is used depends largely on the services requested or agreed upon.

2. What sources and data do we use?

We process personal data that we receive from you as part of our business relationship.
Relevant personal data is:

  • Contact details (name, address and other data for contacting us in a professional context)
  • Payment data (e.g. bank details if you are a sole proprietor)
  • Data required to carry out our contracts
  • Photo/video data (video surveillance of the company premises)
  • as well as other data comparable to the categories mentioned

3. What do we process your data for (purpose of processing) and on what legal basis?

We process your personal data (Art. 4 Para. 2 GDPR) as part of the respective order processing as well as all activities required for operation and administration and to fulfill legal requirements (Art. 6 Para. 1 S. 1 lit. b, c GDPR ). Further details on the purpose of data processing can be found in the respective contract documents and terms and conditions. Your data will not be used for any other purposes, in particular not to create profiles. To the extent necessary, we process your data beyond the actual fulfillment of the contract to protect our legitimate interests or those of third parties (Art. 6 Para. 1 Sentence 1 Letter f GDPR).

4. Who gets my data?

Within European Welding Group GmbH, those departments that need your data to fulfill our contractual and legal obligations receive your data. Processors we use (Article 28 GDPR) can also receive data for these purposes.
‍These are mainly companies in the field of IT services and legal advice.
‍With regard to the transfer of data to recipients outside European Welding Group GmbH, it should first be noted that, according to the general terms and conditions agreed between you and us, we are obliged to maintain confidentiality about all customer-related facts and evaluations of which we become aware.

We may only pass on information about you if this is required by law, if you have consented or if we are legally obliged to provide information. Under these conditions, recipients of personal data can e.g. B. be:

  • Service providers for order support and processing such as debt collection service providers, component producing companies, IT service providers
  • State institutions and institutions under public law if there is a legal or official obligation.
  • Cooperation partners in the context of order processing to whom we transmit personal data in order to carry out the business relationship with you.

Other data recipients may include those entities for which you have given us your consent to transfer data.

5. How long will my data be stored?

If necessary, we process and store your personal data for the duration of our business relationship, which also includes, for example, the initiation and processing of a contract. It should be noted that our business relationship is a long-term obligation that lasts for years.

In addition, we are subject to various retention and documentation obligations, which arise, among other things, from the Commercial Code (HGB), the Tax Code (AO), the Banking Act (KWG) and the

Money Laundering Act (GwG) or the Product Liability Act. The periods specified there for storage and documentation are up to thirty years.

6. Will data be transferred to a third country or to an international organization?

Data transfer to third countries (countries outside the European Economic Area - EEA) usually only takes place if this is necessary to carry out your orders (e.g. payment orders) or is required by law.

7. Do I have an obligation to provide data?

As part of our business relationship, you only have to provide the personal data that is necessary for the establishment, implementation and termination of a business relationship or which we are legally obliged to collect. Without this data, we will usually have to refuse to conclude the contract or carry out the order or will no longer be able to carry out an existing contract and may have to terminate it.

8. What data protection rights do I have?

Every data subject has the right to information in accordance with Article 15 of the GDPR, the right to correction in accordance with Article 16 of the GDPR, the right to deletion in accordance with Article 17 of the GDPR, the right to restriction of processing in accordance with Article 18 of the GDPR and the right to data portability from Art. 20 GDPR. The restrictions in accordance with Sections 34 and 35 BDSG-new apply to the right to information and the right to deletion. In addition, there is a right to lodge a complaint with a data protection supervisory authority (Article 77 GDPR).
If we process your personal data on the basis of a legitimate interest (Art. 6 Para. 1 S. 1 lit. f GDPR), you have a separate right to object in accordance with Art. 21 GDPR.

2. Purposes and legal basis of processing

We process your personal data for the purpose of carrying out the application process and applicant management.

Your personal data is required for the decision to establish an employment relationship and is carried out in accordance with Article 6 Paragraph 1 Sentence 1 Letter b GDPR in conjunction with Article 88 GDPR in conjunction with Section 26 BDSG.

If we receive your consent that we may consider your personal data that we received as part of your application at a later date (Art. 6 Para. 1 S. 1 lit. a GDPR), we will save your personal data the application for the period specified in the consent.

3. Recipients of personal data

Within our company, those departments receive your data that need it to fulfill our contractual and legal obligations. Processors we use (Article 28 GDPR) can also receive data for these purposes. Other forwardings to third parties generally only take place if this is necessary for the execution of the contract, if there is a legitimate interest or a legal or official obligation or if you have given your consent. With regard to the transfer of data to recipients outside the responsible body, it should first be noted that, according to the general terms and conditions agreed between our service providers and us, we are obliged to maintain confidentiality about all facts and assessments of which we become aware. We may only pass on information about you if required by law or if you have given your consent.

4. Duration of storage of personal data

If your data is no longer required for the stated purposes, it will be deleted no later than six months after the end of the application process, unless you have consented to longer storage for consideration at a later date.

In addition, we are subject to various retention and documentation obligations, which arise, among other things, from the Commercial Code (HGB) and the Tax Code (AO). The periods specified there for storage and documentation are up to ten years.

5. Data processing within the framework of the balancing of interests Art. 6 Para. 1 lit. f SDGVO

If necessary, we process your data beyond the actual fulfillment of the contract or the purpose to protect our legitimate interests or those of third parties.

Specifically, this means:

  • Storage in our CRM until the deletion period has expired
  • Email archiving
  • Disposal and destruction of data/files
  • Document archiving

6. Automated decision making

There is no automated decision-making, including profiling.

7. Obligation to provide data

In order to take part in our application process, only the data required to carry it out is required. It is not possible for us to apply without this data.

8. Your rights

You have the right to request information (Art. 15 GDPR), correction (Art. 16 GDPR), deletion (Art. 17 GDPR) or restriction (Art. 18 GDPR) from us regarding your personal data in accordance with the legal regulations. Upon request, we will also provide you with your data in a structured, common and machine-readable format (Article 20 GDPR).

If we process your personal data on the basis of a legitimate interest (Art. 6 Para. 1 S.1 lit. f GDPR), you have a separate right to object in accordance with Art. 21 GDPR.

Regardless of this, you can contact the relevant supervisory authorities if you have any questions or want to lodge a complaint.

9. Right of withdrawal with consent

If you have consented to the processing in a corresponding statement, you can revoke your consent at any time in the future. We will then no longer process your personal data for the purpose collected.
